the myoemshop.com web site and the sale of products
and services offered on this web site are governed
by the terms and conditions set forth below and all
other disclaimers, guidelines, policies and terms
and conditions appearing on this website, including but
not limited to “Our
Policy.” Usage of this website in any manner, whether browsing,
activating an account or purchasing a product / service,
signifies your acknowledgement that you have read our policies
and that you agree to follow and be bound by them. My OEM
Shop reserves the right to modify or change the policies
at any time without prior notice. Therefore, we recommend
that each time you use this web site, you read them carefully. PAYMENTS 1.1 My OEM Shop accepts
major credit cards (Visa, MasterCard, American Express & Discover
card) via Paypal. 1.2 All payments must cleared before the item(s) is shipped
out. 1.3 All PayPal payments
must be from a verified and confirmed account (no exceptions).
If your account doesn’t
meet these criteria a refund will be issued
and your order will be cancelled. 1.4 All local pick up items
must be picked up within 4 business days of order being
placed. If the item(s) isn’t
picked up, it will become the property of My OEM
Shop and we will do with it as we see fit. 1.5 If your item isn’t
available or has been discontinued for reasons beyond
our control within 7 days of purchase date you will be
offered a refund or you will be allowed to choose another
product of equal or lesser value. 1.6 If you are a Canadian
customer and you're not paypal verified & confirmed
please email us since we can accept email money transfers
via www.certapay.com. You must email us before hand to
get approval. SHIPPING / DELIVERY 2.1 We provide shipping
to Canada and U.S.A. Products will be shipped using FedEx
/ Purolator / UPS with a real-time tracking number that
allows you to track the package once picked up by the
courier. 2.2 Delivery times are approximations. We will make every
effort to ensure that your product(s) will arrive on time.
However once the product has been picked up by the courier,
the responsibility is out of our hands. 2.3 To determine when your order will be shipped check
the availability section of the product page. Once payment
has been fully cleared, orders are usually processed between
24 to 48 hours. 2.4 We will only ship to the address posted on your PayPal
account, as a proactive security measure. We will not ship
any items internationally or to any P.O. boxes. 2.5 It is your responsibility to ensure your item is fully
insured in the case of the item getting damaged and/or
is lost in transit. My OEM Shop takes no responsibility
for lost or damaged items. Once the item has left our offices
we are no longer responsible for the item(s). If in the
event an item is damaged or lost, it is your responsibility
to contact the courier for assistance. We will offer any
/ all assistance if required by either parties (i.e. the
customer or the courier). 2.6 Your order comes with standard $100 insurance (additional
insurance can be purchased @ $1.50 per $100). 2.7 All items are shipped
from Toronto, ON, Canada. If your products are being
shipped to a destination outside of Canada, any additional
taxes, Customs Broker Fees and Duty fees are the buyer’s
responsibility. 2.8 Orders received after 5:00 PM Eastern Time (GMT -5:00)
will be processed on the next business day. PRICING & SITE
ERRORS 3.1 My OEM Shop strives to update and keep our prices
and availability as accurate as possible, however we cannot
be held liable for any errors or omissions .We reserve
the right to correct any errors, including after the order
has been submitted and/or processed. In the event of an
erroneous price/availability, we reserve the right to cancel
any orders. We will issue a credit if we cancel your order
after receiving payment. Errors and / or omissions will
be corrected once detected. 3.2 We reserve the right to change our polices / prices
/ availabilities without notice. 3.3 If we cancel your order for any reason, we will issue
a refund if a payment has been made. 3.4 We do not offer price protection on items after they
are shipped but we will adjust any prices on items that
have not been shipped out. RETURNS / EXCHANGE / WARRANTY 4.1 All phones comes with
a 1 year manufacturer’s
warranty. This warranty is offered by the manufacturer
only, and not My OEM Shop. The warranty may be restricted
by geographical constraints and/or other conditions,
so please check with the manufacturer for further
details on you products warranty. Each respected manufacturer
will determine which country the product should be
sent to for servicing. These countries may differ. 4.2 My OEM Shop does not accept returns. All sales are
final. This is for both phones and accessories. 4.3 We provide a 7 day DOA
warranty on defective products. If a product is received
and deemed defective upon arrival according to manufacturer’s
specifications please email us immediately. This
policy doesn't cover physical damage, liquid/water damage,
network issues or compatibility and usage of accessories
not specified in the user manual. 4.4 When returning the product under the DOA policy all
original contents and packaging including: accessories,
manuals, stickers must also be returned in its original
condition. We have the right to refuse any product that
does not meet these conditions or subtract the value of
the missing goods. 4.5 If we are unable to duplicate the problem / defect
stated, your phone will be returned back to you. The defect
has to be a permanent defect and not an intermittent defect. 4.6 We reserve the right to either repair or replace defective
products. No accessories will be replaced unless found
defective. In the event the product can't be repaired or
replaced due to product availability, My OEM Shop will
replace the product with an item of equal or lesser value. ACCESSORIES 5.1 All accessories come with a warranty. 5.2 Each item warranty may differ. Each item warranty
is clearly labeled on the there respective pages. 5.3 If an item is warranty by us (www.shoptsam.com/www.shoptsam.ca)
it basically means that you need to return it to us in
order to have it replaced and NOT THE MANUFACTURES. 5.4 This policy doesn't cover physical damage and / or
liquid / water damage. We reserve the right to reject any
accessory if its deemed non defective, physically damaged
or liquid / water damage. 5.5 It is also your job to ensure that you purchase the
right item(s) for your product, if you are unsure please
email us before hand. 5.6 If we mail out an incorrect item in error we will
replace it with the original item purchased once we have
received the original item we incorrectly mailed out. PRIVACY 6.1 Information on our site
is secured by using a SSL (Secure Sockets Layer) protocol.
This encrypts all information sent to My OEM Shop electronically. We
will not disclose your personal information. We will
not sell or distribute information submitted to us.
We must comply with the law and may have to disclose
personal information to law enforcement officials if
ordered to do so. We may use your information to contact
you from time to time about promotions and sales. |
